Terms of Use & Disclaimer
Effective 2026-10-10. These terms apply to Fair or Not (the “Site”), operated by AblePro, Inc. (“AblePro,” “we,” “us”). By using the Site or submitting a report, you agree to these terms.
1. What the Site is
The Site is a free consumer resource where members of the public share their own experiences with pricing, free trials, fees, offers and cancellations, and where AblePro publishes general consumer information. The Site is not a government agency, a law firm, a debt collector or a complaint-resolution service, and it does not act on anyone’s behalf with any business.
2. Reports are users’ content, not ours
Reports are written by the people who submit them. They reflect those people’s own experiences and opinions. AblePro does not write, verify, endorse or adopt the statements in reports, and the publication of a report does not mean AblePro agrees with it or believes it is accurate. Any reference to a product or business in a report is the writer’s, not AblePro’s.
3. Moderation
We review reports before they appear and may decline, remove, unpublish or recategorize any report at any time, for any reason, including after a dispute. We do not rewrite what users say. We may automatically hide email addresses, phone numbers and long account-like numbers. We are not obligated to publish any report, to keep any report online, or to review the accuracy of statements, and we do not accept responsibility for reports we did not write.
Decisions to publish, decline, unpublish, recategorize or remove content are editorial decisions within our sole discretion. We have no duty to monitor content, and we are not liable for publishing, declining or removing any report. Nothing on the Site waives any protection available to us under 47 U.S.C. § 230 or the First Amendment.
4. Your responsibilities when you submit a report
- You are at least 18 years old.
- You are describing your own, first-hand experience, what you state as fact is true to the best of your knowledge, and you are not affiliated with a competitor of, or employed by, the business you report on.
- You clearly present opinions as your opinions.
- You will not include anyone’s personal information, name or describe individual employees or other private people, or post anything defamatory, threatening, harassing, obscene, discriminatory, or that accuses anyone of a crime.
- You will not post content you do not have the right to share, such as copyrighted text or confidential information, and you will not submit reports on behalf of a competitor or for payment.
- You follow the posting rules.
You are solely responsible for what you submit. To the extent permitted by law, you agree to indemnify and hold harmless AblePro and its officers, employees and agents from claims, damages and costs, including reasonable attorneys’ fees, arising from content you submit or your breach of these terms.
5. Permission to publish
You keep ownership of your report. By submitting it, you give AblePro a worldwide, royalty-free, non-exclusive license to host, store, display, reproduce and distribute it on the Site, to show excerpts of it in search results, social-media previews and links back to the Site, and to include it in counts and statistics that do not quote it. We do not edit the words of reports; we may only publish, decline, unpublish, recategorize, or automatically hide contact details as described in these terms. You can ask us to remove your report at any time through the dispute form (choose “Other” and use the email you submitted with). After we remove it, this license ends, except for copies in backups, copies held by third parties such as search engines, aggregate statistics, and records we keep for legal reasons.
6. Businesses and disputes
If a report is inaccurate, includes personal information, or is not about a real experience, use the dispute form. We review disputes and may unpublish or remove a report, or label it as disputed. We do not take sides in disputes between users and businesses, and we do not accept payment to remove, change or rank reports.
7. Information on the Site is general, not advice
Guides, category pages and other content are general consumer information as of the date they were written. They are not legal, financial or tax advice, may not apply to your situation, and may become out of date as laws, prices and company policies change. Mentions of free alternatives or official apps are for information only; AblePro has no relationship with those companies and receives nothing for mentioning them.
8. Disclaimer of warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ABLEPRO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM CONTENT POSTED BY USERS OR FROM RELIANCE ON ANY CONTENT ON THE SITE. ABLEPRO’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE IS LIMITED TO ONE HUNDRED U.S. DOLLARS.
10. Acceptable use
Do not use the Site to send spam, scrape it in bulk, interfere with its operation, impersonate anyone, or get around our limits. We may block access that we believe is abusive.
11. Copyright and trademark
If you believe a report uses your copyrighted material or trademark without permission, use the dispute form and choose “Copyright or trademark.” We review these requests and may remove material.
12. Children
You must be at least 18 years old to submit a report or a dispute. The Site is not directed to children under 13, and we do not knowingly collect personal information from them; if we learn we have, we will delete it.
13. Changes, governing law and where claims are brought
We may update these terms; the effective date above shows the latest version, and continued use means you accept the updated terms. These terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise. Any claim relating to the Site must be brought only in the state or federal courts located in Rankin County, Mississippi, and you consent to their jurisdiction. Where the law allows, any claim must be filed within one year after it arose.
